Activist Sues Jonathan, Others Over Reinstatement  Of  Controversial Prof.  as   Chairman Of Federal Character Commission

Professor Shuaibu  Oba Abdulraheem is once  again in the news negatively.The controversial former vice chancellor of the University of Ilorin during the protracted crisis that rocked the Ivory Tower  is the subject of yet another litigation in his new office .A Civil Society Activist, Comrade Hassan Isah, has filed a suit at the Federal High Court, Abuja against the President of the Federal Republic of Nigeria, Secretary to the Government of the Federation, Attorney-General of the Federation, Prof. Shuaibu Oba Abdulraheem and Alhaji Mohammed Ari Gwarska, challenging the purported re-instatement of Prof. Abdulraheem as Chairman of the Federal Character Commission.

In the affidavit in support of the Originating Summons filed today at the Federal High Court by Comrade Hassan Isah, he alleged as follows:

“11.  That on the 13th day of December, 2010, the 5th Defendant(Oba Abdul raheem) forwarded a letter to the 1st & 2nd Defendants(President and SGF), resigning his position as the then Chairman of the 4th Defendant to enable him contest for a political position in Kwara State. The letter  is annexed as “EXHIBIT FEDERAL CHARACTER 2”.

12.           That on the 5th of January, 2011, the 1st and 2nd Defendants, wrote a letter with reference No. SGF.19/S.51/7/692 accepting the resignation of the 5th Defendant and directing that the said resignation take effect from 3rd of January, 2011 and that the 5th Defendant hand over to the 6th Defendant as the Acting Chairman of the 4th Defendant. The said letter is annexed as “EXHIBIT FEDERAL CHARACTER 3”.

13.           That the 5th Defendant was paid all his entitlements and/or emoluments after his resignation as the Chairman of the 4th Defendant.

14.           That the 5th Defendant failed in his bid to secure the political position he sought to contest.

15.           That on the 11th of August, 2011, the 1st and 2nd Defendants wrote to the 5th Defendant purportedly accepting a letter of withdrawal of resignation and purportedly re-instating the 5th Defendant as Chairman of the 4th Defendant. The said letter is annexed as EXHIBIT FEDERAL CHARACTER 4”.

16.           That I know as a fact that the 5th Defendant ceased to hold office as the Chairman of the 4th Defendant(Federal Character Commission) as from the 13th day of December, 2010.

17.           That I know as a fact that after the resignation of the 5th Defendant, he was paid all his entitlements and emoluments as the former Chairman of the 4th Defendant.

18.           That I know as a fact that the 5th Defendant’s name was never sent to the Senate of the Federal Republic of Nigeria before his purported re-instatement.

19.           That I know as a fact that the 5th Defendant was never presented to the Senate of the Federal Republic of Nigeria for approval/confirmation.

20.           That I know as a fact that the Senate of the Federal Republic of Nigeria did not confirm or approve of the re-instatement/re-appointment of the 5th Defendant.

21.           That based on the above, the 5th Defendant now wants to assume the office of the 4th Defendant’s Chairman.

22.           That I know as a fact that the 6th Defendant is now planning to hand over to the 5th Defendant as Chairman of the 4th Defendant. The internal memo of the 4th Defendant is annexed as “EXHIBIT FEDERAL CHARACTER 5”.

23.           That if this Honourable Court does not intervene, the Defendants will continue to breach the provisions of the Constitution and the Federal Character (Establishment etc) Act.”
