Sylva vs PDP:Court adjourns Indefinitely
Newsdiaryonline Tue Nov 22,2011

Sylva

The Federal High Court In Abuja has today adjourned sine die the case between Governor Timipre Sylva and  the Peoples Democratic Party,PDP.

The court’s ruling came upon the realisation that the PDP has filed a case at the Court of Appeal seeking to overturn the Federal High Court order asking the PDP to appear before it and show cause why Sylva should be disqualified from its primaries.

The Federal High Court judge,Gabriel Kolawole  noted today that once it is known that a case is at the higher court , it was proper to adjourn  indefinitely.

Observers noted that the case may have become more interesting. One insider said ,it is apparent that the PDP has admitted technically the receipt of the court order. And excerpt it is so ordered by the appellate court, the case may not come back to the lower  court. The legal fireworks may proceed from the appellate court to the Supreme court.

The PDP defied the High Court order and proceeded last weekend to hold it Bayelsa  state primaries in which Seriake Dickson, emerged as its governorship candidate.INEC which did not attend the primaries because of the court order is said to be rejecting the result .

Sylva wants to be recognized as the PDP candidate since his  earlier emergence before the suspended April poll has not been quashed. But the PDP chief under the behest of President Goodluck Jonathan  do not want Sylva reelected, thus setting the stage for the unfolding titanic battle.

Meanwhile Dickson is seeking the relief of the court to be joined in the suit as the outcome will likely affect him.
